As soon as a pattern is published, it is copyrighted. You must have permission from the designer or publisher in order to sell derivative works (items created using the pattern). Some patterns will say explicitly whether you can sell items made from them. Others say you cannot. If the pattern does not specify, you must contact the designer/publisher and get permission first.

Depends on the license you’ve negotiated with the pattern company. http://www.sewgirls.com/sewing/Patterns-3976-0.htm

The bigger reason you don’t want to use home sewing patterns is that they’re not well engineered compared to patterns manufacturers use. The difference between sewing with a good pattern and the usual home sewing pattern is night and day.
